This Privacy Policy describes how and why Nik Courtney Portrait Artist collects, uses, and shares information when you have an account on this website, commission a portrait or make an enquiry. Please take the time to read the below information thoroughly and if you have any questions, please do not hesitate to get in touch.

If you choose to commission a portrait or contact me for more information, then you agree to the collection and use of information in relation with this policy. The Personal Information that I collect is used for providing and improving my service. I will not use, share, or sell your information with anyone except as described in this Privacy Policy.

In order to provide you with my service, I need you to provide me with certain personally identifiable information, including but not limited to your name, phone number, email and postal address. The information is usually collected during the purchase process, and will be used to contact and identify you, process and fulfil your order, provide customer support before and after sale, and to post the portrait to you.

1. Processing Your Data

1.1 General

I value your trust in providing me your Personal Information, thus I am striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and I cannot guarantee its absolute security.

When you provide me with reference photos, I create a folder in my One Drive, entitled with your name. This is purely to allow me to keep a record of my catalogue of work. To keep you updated on progress I may share images of your portrait with you via direct message or email.

Information relating to purchases is generally kept for 7 years for tax purposes.

General enquiries will be removed from my records after 6 months.

If you ‘voluntarily’ purchase something from me, I process the following data:
 

  • Full name (Legal requirement)

  • Address (To check payment is legitimate)

  • Email Address (So I can contact you)

  • Payment details (To pay for the goods or service provided)
     

*Please note that I do not process and / or store any card, bank or credit card information. All payments for origianl works and prints are processed through either Wix Payments or PayPal who are fully GDPR compliant and secure, commissions are usually paid for by bank transfer.

 

I process this data to supply the goods and/or services you have purchased and to keep records of such transactions. My lawful ground for this processing is the performance of a contract between you and I and/or taking steps at your request to enter into such a contract.

1.2 Communication Data

I may process the following categories of communication data about you:

 

Communication Data that includes any communication that you send to me whether that be through the contact form on my website, through email, text, social media messaging, social media posting or any other communication that you send me. I process this data for the purposes of communicating with you, for record keeping and for the establishment, pursuance, or defence of legal claims. My lawful ground for this processing is my legitimate interests which in this case are to reply to communications sent to me, to keep records and to establish, pursue or defend legal claims.

 

I may use User Data and Technical Data to deliver relevant website content and advertisements to you (including Facebook adverts or other display advertisements) and to measure or understand the effectiveness of the advertising I serve you. My lawful ground for this processing is legitimate interests which is to grow my business.

 

1.3 Sensitive Data

I do not collect any Sensitive Data about you. Sensitive data refers to data that includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data. I do not collect any information about criminal convictions and offences.

 

Where I am required to collect personal data by law, or under the terms of the contract between me and you do not provide me with that data when requested, I may not be able to perform the contract (for example, to deliver goods or services to you). If you don’t provide me with the requested data, I may have to cancel a product or service you have ordered but if I do, I will notify you at the time.

 

I will only use your personal data for a purpose it was collected for or a reasonably compatible purpose if necessary. For more information on this please get in touch. In case I need to use your details for an unrelated new purpose I will let you know and explain the legal grounds for processing.

 

I may process your personal data without your knowledge or consent where this is required or permitted by law.

1.4 Marketing Communications

My lawful ground of processing your personal data to send you marketing communications is either your consent or my legitimate interests (namely to grow my business).

 

Under the Privacy and Electronic Communications Regulations, I may send you marketing communications from me if (i) you made a purchase or asked for information from me about my goods or services or (ii) you agreed to receive marketing communications and in each case you have not opted out of receiving such communications since.

 

You can ask me or third parties to stop sending you marketing messages at any time by following the opt-out links on any email message sent to you or by getting in touch with me.

 

If you opt out of receiving marketing communications this opt-out does not apply to personal data provided as a result of other transactions, such as purchases, warranty registrations etc.

I may receive data from third party analytics providers such as Google, who are based outside the EU and advertising networks such as Facebook who are also based outside the EU.

2. Data Disclosure Policy

I require all third parties to whom I transfer your data to respect the security of your personal data and to treat it in accordance with the law. I only allow such third parties to process your personal data for specified purposes and in accordance with my instructions.

Technical Data includes data about your use of my website and online services such as your IP address, your login data, details about your browser, length of visit to pages on my website, page views and navigation paths, details about the number of times you use my website, time zone settings and other technology on the devices you use to access my website.
 
I process this data to analyse your use of my website and other online services, to administer and protect my business and website, to deliver relevant website content and advertisements to you and to understand the effectiveness of my advertising.

My lawful ground for this processing is my legitimate interest which in this case is to enable me to properly administer my website and my business and to grow my business and to decide my marketing strategy. 

My company is hosted on the Wix.com platform. Wix.com provides me with the online platform that allows me to sell my products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall.

All direct payment gateways offered by Wix.com and used by my company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by my store and its service providers.

 

I may contact you to notify you regarding your account, to troubleshoot problems with your account, to resolve a dispute, to collect fees or monies owed, to poll your opinions through surveys or questionnaires, to send updates about my company, or as otherwise necessary to contact you to enforce my User Agreement, applicable national laws, and any agreement I may have with you. For these purposes I may contact you via email, telephone, text messages, and postal mail.

 

I reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If I make material changes to this policy, I will notify you here that it has been updated, so that you are aware of what information I collect, how I use it, and under what circumstances, if any, I use and/or disclose it.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, I may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive or refuse to comply with your request in these circumstances.

 

I may need to request specific information from you to help me confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. I may also contact you to ask you for further information in relation to your request to speed up my response.

 

I aim to respond to all legitimate requests within one month. Occasionally it may take me longer than a month if your request is particularly complex or you have made a number of requests. In this case, I will notify you.

5. Children's Privacy

5.1 General

 

My Services do not address anyone under the age of 13. I do not knowingly collect personal identifiable information from children under 13. In the case I discover that a child under 13 has provided me with personal information, I will immediately delete this from my records.

 

If you are a parent or guardian and you are aware that your child has provided me with personal information, please contact me so that I will be able to take necessary action.

 

If you provide me with information or photographs of your charges as a basis for a commissioned portrait, then I will seek your written consent to use these images to promote my service through Facebook, Instagram, flyers etc.

6. Sharing Information

6.1 General

 

To promote my service, Nik Courtney Portrait Artist uses third party platforms including Facebook and Instagram which have their own Privacy practices that I do not own or control. You can access each of these services Privacy documents through their own websites.

 

I will always ask for your permission in writing to share your photographs and your portrait through such platforms.

Your information is never sold or shared by me to outside services or companies.

Forenames and home towns/countries will be referenced, with customer permission, in any testimonials.

7. Data Rentention

7.1 General

 

I will only retain your personal data for as long as necessary to fulfil the purposes I collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

When deciding what the correct time is to keep the data for I look at its amount, nature and sensitivity, potential risk of harm from unauthorised use or disclosure, the processing purposes, if these can be achieved by other means and legal requirements.

I may update my Privacy Policy from time to time. Therefore, I advise you to review this page periodically for any changes. I will notify you of any changes by posting the new Privacy Policy on this page.
